The FM3 is a one-year, non-immigrant permission to reside in Mexico. By non-immigrant, they mean it is for a specific, stated purpose. It will say to study, as a retiree, or the specific name of the company you will be working for, etc. A retiree FM3 won't give you permission to work or have any business dealings. However, it is possible that some retirees have FM3 issued to them as business owners, etc. As far as I know, there is no actual requirement to spend x number of days per year in Mexico as an FM3 holder. You can come and go as you please.

After 5 years with an FM3, they used to promote you to FM2, immigrant status. This could only be obtained after 5 years as an FM3 holder. This was basically a permanent immigrant class visa, allowing you to work and do business anywhere.

However, it is my understanding that they aren't giving out FM2s anymore, at least to retirees in some states, but that you can apply for citizenship after 5 years residing in the country with an FM3.
